Alleged DUI Driver Arrested in 6 Fatalities Crash on 60 Freeway

The Chevrolet Camaro was allegedly going the wrong way at a speed in excess of 100mph according to witnesses. The alleged driver of the Camaro, Olivia Carolee Culbreath, 21, of Fontana, survived the crash with a broken leg and internal injuries. She was charged with DUI and Felony Manslaughter in this DUI accident

The human aspects of this case are profound. The legal aspects of this case are far from certain. The California Penal Code Section 192(c) Vehicular Manslaughter with gross negligence carries a maximum 6 year sentence, however factors in this case could allow for a charge of 2 nd degree murder.

Will the prosecutor be able to prove that defendant drove her car with such recklessness and disregard for human life that her actions went beyond mere negligence? In this case the defendant had a prior DUI. If she was warned by the court during her prior DUI case, that may open the door for a charge of 2 nd degree murder.

Factors such as the speed of the defendant’s car and the amount of alcohol or drugs allegedly in the defendant’s system are factors to consider.. A great attorney will investigate both these factors thoroughly in preparing the case. The decision to hire the right DUI lawyer is the most crucial decision that a person can make when facing a DUI prosecution. Make your decision count. Give me a call and talk to me personally.
